Bausch + Lomb to sue Ciba over contact lenses ad

By Martin Burns

Contact lens manufacturer Bausch + Lomb has filed a lawsuit against Ciba Vision over an advertising campaign.

The ad claims that Ciba's Clear Care contact lens solution is "demonstrably better" than Bausch + Lomb ReNu MultiPlus, but the company says these claims are false and has filed a lawsuit with the US District Court for the Western District of New York.

A number of industry publications have run the advertisement, including Review of Optometry, and the suit seeks a court order which would prevent Ciba and its parent company Novartis AG from running the campaign.

The suit centres on the effectiveness of the two solutions in disinfecting contact lenses against the dangerous single-celled protozoa Acanthamoeba, but Bausch + Lomb is requesting that "corrective advertising" is used wherever these comparisons is made.

Earlier this month, contact lens manufacturer Novartis won a case against pharmaceutical giant Johnson & Johnson to sell its extended wear contact lenses in France, a right which Johnson & Johnson had sought to remove through the French courts.
